1. Agreement
By accessing or using chatspick.com and related services ("Chat's Pick"), you agree to these Terms of Service. If you do not agree, do not use our services.
2. Service Description
Chat's Pick is a free concierge for people deciding who to pick. Chat's Pick does the work: it checks the record, asks the top 12 chats, goes undercover as a secret customer, and makes the best pick; every pick is written up as a review and broadcasted to the top 12 chats. Businesses may join as members. Membership licenses the Chat's Pick mark for the member's website, advertising and materials while membership is active.
3. No Guarantees
Selection is made by Chat's Pick from the business's record at the time of review, and may change. Chat's Pick does not guarantee outcomes, revenue, customers or return on investment.
4. Income Disclaimer
Any income examples, projections, or earnings references provided on this site or by our representatives are illustrative only. Actual results depend on individual effort, market conditions, and other factors. Earnings are not guaranteed. Past performance does not indicate future results.
5. Cookies & Tracking
Chat's Pick does not use cookies, tracking pixels, or any form of browser-based tracking. We do not install any software on your device. IP-based geolocation is used solely to detect your approximate location for language and regional content.
6. Data Collection
Information you voluntarily provide through contact forms, onboarding, or registration is used solely to deliver the services you requested. Consumer search queries are not stored or linked to any individual. We do not sell, rent, or share personal information with third parties without your prior consent.
7. Membership
Membership licenses the Chat's Pick mark while membership is active. The area and term are stated in the member's agreement. If membership lapses or the member no longer qualifies, the license ends. Referrals are free. When a consumer asks us to have the member contact them, we pass the request to the member at no charge.
8. Intellectual Property
Chat's Pick, the Chat's Pick logo, and all associated branding are trademarks of Rustguy, Inc. Unauthorized use, reproduction, or distribution of our trademarks or content is strictly prohibited.
9. Selection
A Chat's Pick referral is our selection, made in good faith from the information available; it is not a warranty of the business's work. Users should exercise their own judgment before engaging any business.
10. Third-Party Links
Our platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or policies of any third-party sites.
11. Limitation of Liability
To the maximum extent permitted by law, Chat's Pick and Rustguy, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
12. Indemnification
You agree to indemnify and hold harmless Rustguy, Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.
13. Modifications
We reserve the right to modify these Terms of Service at any time. Changes take effect upon posting. Continued use of our services constitutes acceptance of modified terms.
14. Governing Law
These terms are governed by the laws of the State of Nevada, United States. Any disputes shall be resolved in the courts of Clark County, Nevada.

16. Unsolicited Communications
You are solely responsible for compliance with all federal, state, local, and international laws regarding unsolicited communications, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and equivalent regulations in all jurisdictions. Sending unsolicited SMS or text messages to businesses or consumers without prior express consent is strictly prohibited. Any fines, penalties, lawsuits, or legal action resulting from unsolicited messaging are your sole responsibility. Chat’s Pick and Rustguy, Inc. bear no liability for any communications you initiate. By using any Chat’s Pick product or service, you agree to these terms.
